Terms of Service
1)All flight expenses such as: fuel, ramp fees, landing fees, enroute traffic and navigation charges will be billed directly to the registered aircraft owner/operator and are NOT included in any of the cost proposals issued by FlyHire Aviation, LLC or the ferry pilot.
(2)The ferry pilot will operate the said aircraft in accordance with the operating handbook and under the manufacturers specifications and recommendations and in accordance with all US and foreign laws and aviation regulations.
(3)ALL AIRCRAFT must have a valid airworthiness certificate, Current Registration and/or appropriate WAIVER(s), in some cases FERRY FLIGHT PERMISSION (ferry permit) and/or Special Airworthiness Certificate. . (4)FlyHire Aviation, LLC or any of its representatives and/or associates are NOT responsible for any aircraft component, property, hull, bodily injury, or system failure/damage before, during and after the ferry flight. (5)Unless specified, all aircraft insurance is to be provided by the aircraft owner/operator. A proof of insurance, aircraft owner consent, and a hold harmless agreement must be signed and in possession of FlyHire Aviation, LLC prior to movement of any aircraft. The owner/operator acknowledges that he/she has received prior approval and consent from the primary insurance carrier that authorizes the addition of the ferry pilot to be covered under the policy. In the event that the owner/operator desires not to maintain appropriate insurance, refer to section (4). Individual countries may require proof of insurance. In such event, FlyHire Aviation, LLC will notify the owner/operator of the specific regulation. If necessary, FlyHire Aviation, LLC can assist in acquiring the appropriate insurance for the proposed ferry flight. All insurance related policies are in the full responsibility of the aircraft's Owner and/or Operator. FlyHire Aviation, LLC, or the contract pilot shall NOT be held liable for any losses.
(6) Registration is required for legal ownership. The only way to be sure of registration is to check with the FAA Aircraft Registration Branch, in Oklahoma City. Every three years the validity of this registration must be confirmed to the FAA FAR Part 47. Registration expires according to Advisory Circular 61-23B after any of the following: can be obtained
(7)Day VFR minimum equipment: airspeed, altimeter, compass, tachometer, fuel gauge, oil temperature, oil pressure, (gear indicator and manifold pressure). Night VFR minimum equipment in addition of day VFR: position lights, beacon, power source, and a flashlight. Class D, C and B require radio, and an encoding transponder.
(8)Transponder required above 10,000' ft MSL, and above ARSA. FAR 91.413 require that the transponder to be checked and certified within the preceding 24 calendar months.
(9)Emergency Locator Transmitter (ELT) is required on all aircraft with some exceptions. FAR 91.207. 50 nm training flights are exempted. The ELT battery must be replaced after one hour of use or on a date of expected half-life. The ELT must be placarded and signed as to date of installation and the expiration dates of this half-life. The logbooks also require a signature by an Airframe & Power Plant (A&P) for this information. IFR flight has specific checks of VORs, altimeters, and static systems.
(10)Aircraft Certificate, Pilots Operating Handbooks, Aircraft Registration, and current weight and balance must be available for inspection and will accompany each flight.
(11)Aircraft, Airframe, and Engine logs must be available for inspection.
(12)Placards or manuals must be in every aircraft, giving the performance limitations of the aircraft not limited to maneuvering speed, gross weight, prohibitions, and performance. Color-coded markings on the instruments are part of the limitations. Color codes on the airspeed indicator show never exceed speeds, normal operating speeds, flap operating speeds, and turbulent air limitations. The tachometer shows never exceed RPM, and sometimes ranges to be avoided for continuous operations. Normally, you wouldn't need a specific document, on file with the FAA, listing the operating limitations for a specific model aircraft.
(13)Weight and balance papers are specific to each aircraft and must be available. Any subsequent items permanently affixed to the aircraft must be added as weight and balance elements to the papers. It is a violation of the FARs to operate an aircraft in non-compliance of the operating limitations of the airworthiness certificate. Some aircraft manuals (Mooney's) are required equipment.
(14) Airframe and engine logbooks must show all maintenance performed. All aircraft are required to have annual inspections. Minor maintenance may be performed by other than a licensed mechanic. It is a violation of the FARs to operate an aircraft in non-compliance of the operating limitations of the airworthiness certificate. The recommendations of manufacturer bulletins and the operating handbook regarding maintenance should be followed. FAR 91.407 requires a flight check and aircraft sign-off for any maintenance that changes flight characteristics.
(15)All EQUIPMENT in Aircraft must be in WORKING condition or appropriate WAIVER in existence. (16)In some cases our Pilots will FERRY aircraft together with the OWNER. Be aware that in such instances, the costs are higher in terms of emergency/survival equipment, handling, and hospitality matters. The contracted pilot may also charge an hourly Rate of $30.00 to $100.00 a Flight Hour depending on the aircraft. (17)In some instances, FlyHire Aviation, LLC may require safety and check out flights at the expense of the client. The check out procedures would consist of: Ground Inspection, Local and/or Long Range test flight(s). Test flights are at the discretion of the Ferry Pilot. Average Test Flight times are approximately 0.5-1.5 hours for Domestic Flights and 1 to 3 hours for Long Range / International /Oceanic Ferrying. Any discrepancies will be addressed prior to the proposed ferry flight. Any discrepancies affecting the airworthiness of the aircraft shall be addressed by an appropriate maintenance facility and the appropriate entry will be made in the aircraft logbooks. All maintenance expenses will be the responsibility of the aircraft owner and/or operator.
(18)FlyHire Aviation, LLC reserves the right to REFUSE a flight at any time the pilot deems necessary. Safety concerns are at the discretion of the ferry pilot. Any maintenance requirements that arise during the ferry flight are the responsibility of the aircraft owner and/or operator. Any pre-paid funds will be refunded with the exception of expenses already incurred during the flight. If the flight is unable to be completed in a reasonable time period (discretion of pilot), the pre-negotiated daily fee for the pilot, as well as any travel expenses for the pilot will be charged to the client, owner and/or operator until which time the pilot arrives back at his/her home airport.
(19)Our cost estimates are honest and accurate. Once terms between the ferry pilot and the owner and/or operator are agreed upon, airfare and arrangements for the pilot must be completed within 5 days of the date of estimated departure. Short notice arrangements can be made when scheduling permits. In addition, there may be a fee of $100 domestic and $400 for International flight that require expeditious handling of permits (less than 14 days).
(20)Expense Payments can be placed with your Visa or Master Card via PayPal.Com or You Can E-mail customerservice@FlyHireAviation.com for our bank transfer information. All Payments/Deposits over $2000 USD and/or from Overseas Clients must use a bank transfer.
(21)Expense receipts will be provided by the pilot at the time of delivery. Personal checks are NOT accepted. Certified funds, cash, or credit card are generally accepted. All estimated expenses shall be paid to the Ferry Pilot prior to aircraft departure from origin airport, with full payment or refund due upon delivery of the aircraft. Extended Weather/Mechanical/Paperwork/Customs Delays
(22)In the Event of an extended weather, mechanical, paperwork, or customs delay: The prearranged daily rate of the ferry pilot will continue to accrue. In addition to the base pilot fee, hotel, rental car, and a $25 pilot concession fee will also be the responsibility of the client.
(23)Our average daily pilot standby rates: (fees will be prearranged) $100-$250 per day (Single Engine Domestic) $250-$500 per Day (Multi Engine, Oceanic, International Flights, Test Flights, Major Mechanical or Customs Delays)
Deposits/Cancellations/Refunds
(24)Flight Deposits: In most cases, the client may book airfare for the Ferry Pilot as a deposit. Payment for estimated flight expenses will be due prior 7 days (168 hours) of proposed departure for International flights, and 3 days (72 hours) for Domestic flights. Airfare that is used for a deposit will only be refunded according to the Airline’s refund policy. FlyHire Aviation, LLC is not responsible for money lost due to cancellation of the flight.
(25)Refund of Deposits: Refunds will be returned at the time of final delivery along with an invoice of expenses, or a certified check will be mail along with a detailed invoice within a 10 day completion of the mission.
(26)Cancellations: Domestic flight cancellation notification must be made prior to 72 hours of the intended departure date. Domestic Flights cancelled prior to 72 hours will not be penalized. However, any flight planning fees such as charts, airfare, etc., are the responsibility of the client. Domestic Flights cancelled less than 72 hour notice shall be imposed a $100 cancellation fee plus a 1 day prearranged pilot fee.
(27)International and Transoceanic flight Cancellations: must be made prior to 7 days (168 hours) advanced notification from proposed departure date. International flights cancelled prior to 7 days (168 hours) will be assessed a $150 cancellation fee plus any expenses for flight planning, permit fees, charts, airfare, etc. International flights cancelled less than 168 hour notice shall be imposed a $500 cancellation fee plus a 1 day prearranged pilot fee.
(28)If for any reason a client wishes to cancel a Domestic/International/Oceanic ferry flight/Test Flight after the flight has commenced: the client is subject to forfeiture of any and all deposits, fees, and daily prearrange pilot fees will be accrued until the pilot has returned to his/her home airport; in addition, a $200(domestic) or $500(International) last minute cancellation charge will be assessed. Return travel arrangements for the pilot including airfare, hotel, rental car and $25 pilot concession fee are sole the responsibility of the client, owner and/or operator.
(29)Any refunds will be via bank transfer or certified check will be mailed within 10 business days.
Equipment Rental
(30)HF Radio Equipment, Satellite Phone's, Liferafts, & Survival Equipment (Oceanic Clients Only) are the responsibility of the client. Rental of these named items are available for a prearranged fee.
(31)Satellite Phone Service: For aircraft that are unable to gain FAA approval for installation & fabrication of temporary HF radio equipment, or that are using the pacific routes, will need to use a satellite phone. A $150.00 non refundable rental/access charge + $2.00 Per Minute will be assessed for Position Reports. Position reports will be made 5 minutes after each hour while under Oceanic Control.
(32)Liferaft’s weight is about 48lbs. The compressed gas cylinder and is considered a hazardous material.
(33)Shipping cost to return the HF Radio Equipment, Life Raft, & Survival Suit are the responsibility the client. These items can typically be checked as extra baggage aboard most major airlines. parties involved
